During her confirmation hearing before the U.S. Senate, probably this summer, Supreme Court nominee Sonia Sotomayor will be questioned about her role in Ricci v. DeStefano, the potentially groundbreaking, reverse discrimination case brought by city firefighters denied promotion in New Haven.

Sotomayor displeased conservatives when she and the two other judges on a three-judge panel of the U.S. 2nd Circuit Court of Appeals ruled against the firefighters — 19 whites and a Hispanic — in February 2008.

This is not an isolated incident.

    I hope affirmative action does end. I am glad the S.C. ruled the way they did on this case. Nothing against those who are considered minorities but it takes away the sense of competition and hiring the best applicant and having to hire someone strictly because of color or race.

    I think its funny how over 90% of african-americans voted for Obama during the election and there was nothing said about it. What would have been said if 90% of the white population voted for McCain? Everyone would have been talking about how racist caucasians are. I can understand somewhat because this is the first black president, but still. From this perspective, its seems like the african-americans are the more racist part of the population.

    i am a conservative and a republican. i dont honestly think any viciousness was intended (although the possibility of my being wrong is ever present). I do think that when the decision to prevent the white firefighters from getting the job simply because they were born white it really leaves alot to be questioned: what kind of person makes a decision based on avoiding a lawsuit instead of finding the most qualified candidate for a job?

    This is one big reason never to vote Democrat. First the scum at the city that said the people who passed couldn’t be promoted because they were only white and hispanic, and secondly the judges they appoint like Sotomayor and the SC liberals who all 4 of voted against overturning this. If one race doesn’t pass a test, that is not a basis at all for throwing out the people’s results who did. That is racism. Other blacks in US could have passed, these didn’t, too bad. Keep the results.

    “The city said it acted to avoid a lawsuit from minorities, but Justice Anthony Kennedy said in his majority opinion that New Haven’s action amounted to discrimination based on race against the white firefighters who were likely to be promoted.

    “No individual should face workplace discrimination based on race,” Kennedy said.
