Why does Sotomayor think white firefighters should not get raises and promotions?
In Connecticut, a fire district gave a test to all of it's firefighters to determine who gets promoted. A large percentage of those who got the highest scores were white. The dems in Connecticut went nuts and told the white firefighters they couldn't have the promotions they earned because not enough minorities were represented. The case went to court and Sotomayor was the principal reason the white firefighters were turned down in their request to get the promotions they earned!
Why would a judge tell anyone who earned a promotion that they can't have it because they're white? Is Sotomayor a racist, sexist, or both?
I think that the firefighter incident is ridiculous. Those guys who passed the exams worked their butts off. The one guy was even dyslexic.
But due to past history, many people believe that blacks are entitled and should be given things instead of working for them like everyone else. This mindset started around the time of the rise of the Black Panthers and it has done Blacks more harm than good.
Seriously, if your house is on fire or you are in a car crash do you really care what color the firefighter who arrives on the scene will be? Or do you care more about whether or not they know what they are doing?

She doesn't. The appellate court just supported the decision of the lower court, that the City of New Haven was not required to promote anyone.
The city of New Haven was simply trying to fulfill its obligations under federal law when confronted with test results that had a disproportionate racial impact.

I'd say it was a good career move for her right about now.
Every test in the world can be shown to be biased. I guess all tests should be thrown out so life could be fair. Then, we should plow down the mountains and fill in the oceans so everyone lives on the same plain.

The issues isn't giving the firefighters their promotion, it is an issue of whether the test was fair. In science they try and make sure the test is valid and reliable across all different groups, times and such. This test obviously wasn't. In similar situations with different tests the tests have been found not to be a good judge or knowledge. I even believe the SAT had some of these problems with minority students and possibly rural students getting disproportionately worse scores than their counterparts. Understanding a lot about test development helps understand this situation much better

She is racist and there is a huge double standard in this country, that's why. If it were a group of any minority that was told that when they passed the test, the ACLU would be suing someone so fast their heads would spin. The test was not racially biased. But some people cannot stand on their own two feet. They have to make excuses for why they are sorry. It all comes down to accountability. If you can't earn something the right way, then you shouldn't get it and those who can should not be penalized, whether they are black, white, green, or orange with purple stripes!

First off, no judge told anyone they couldn't have a promotion.
Secondly, the test was given to see who QUALIFIED for a promotion, not who was going to get promoted.
Lastly, there isn't a law around that says a city has to give promotions to employees.

It shouldn't even be an issue for her. The whole premise of promotional exams as administered by most fire departments (police as well) is exclusive as they only consider internal candidates. It really has nothing to do with the most qualified but rather the best performers on restricted access exams administered to give the vail of equality when in reality they have nothing to do with job performance and being most qualified. Fire Departments should grow up.

First to clarify there was a latino fireman in among the 13 firefighters. Second Sotomayor wasn't necessarily saying firemen couldn't get raises, but rather a city could determine whether or not firemen recieved raises when the city felt there was misrepresentation. Let's be honest, the city was full of crap. There were so few black firemen elgibile for that test compared to the number of whites and latinos that it's no surprise the few who took it didn't pass compared to the hundreds who took the exam. Actually I don't believe the city wanted anyone to pass and just used it as an excuse.
I think what's important about the decision is that latinos are making up a larger and larger portion of our society, are and or will be a majority. So Sotomayor sided against the latino for the african american…That's a big deal in my book. It shows she's willing to look beyond a persons simply being latino in making a decision.
I don't really know if she sided for the Afircan American since no one got a promotion. So the winner was the city which got out of annual raises and will probably do so again next year.

To begin, any law student, lawyer, or judge would know that the facts of this case were not simply, "Should white people get raises," which you essentially stated in your question.
The suit dealt completely with the fairness of the exam. As in any type of standardized test given in the states, those of US descent will out-perform minority groups/immigrants simply because they have a better understanding of the English language.
It has nothing to do with whites not deserving a raise, it has to do with the question of whether or not this country is to being truly 'equal,' as stated in the constitution.
Liberal or Conservative, the decision was the correct legal decision to be made in this case.

The FACT is that if you took just a little bit of time to read the details instead of just sprout out based on your lack of knowledge of the case, you'd clam up fast. Sotomayor was 1.) one of THREE in a unanimous decision and 2.) did not "make" any decision whatsoever — the decision was to allow the PREVIOUS court's decision to stand.
So, if you really want to educate yourself (this IS "Yahoo ANSWERS" after all), you'll respect the evidence people provide–not the vague, biased heresay which seems, by your questions, to be the only things you're listening to.

U.S. District Judge Janet Bond Arterton, sitting in New Haven, initially ruled against the firefighters after taking evidence. In a 48-page, unpublished summary judgment order, she wrote that New Haven's reason for throwing out the test was related to the racial distribution of the results. But she concluded that there was no discrimination because the test results were discarded before anyone was promoted.
Sotomayor and the two other judges on the 2nd Circuit panel that heard the appeal waived restrictions on the length of legal briefs and time allotted for oral argument. In an apparent measure of the significance of the case, the parties were permitted to submit 86-page briefs and an 1,800-page appendix. They were given an hour to argue.
On Feb. 15, 2008, in a single, unpublished paragraph, the panel affirmed Arterton's "thorough, thoughtful, and well-reasoned opinion." It also said it was sympathetic to the plight of one of the plaintiff firefighters whose dyslexia required him to take extraordinary measures to prepare for the test.

That case is being reviewed now by the SCOTUS, and they will undoubtedly reverse Sotomayor's racist ruling.

In the Connecticut case, the firefighters' test was designed by outside experts to be free of any racial bias. The white firefighters studied harder and scored higher on the unbiased test. Sotomayor ruled in favor of the liberal demand for equality of results, which cannot mean equality of opportunity, for individual effort makes unequal results.
In a famous comment Sotomayor is trying to disown, she said, "A wise Latina woman with the richness of her experience would more often than not reach a better conclusion than a white male who hasn't lived that life." Everyone knows what would have long since happened to a white male nominee who said, "A wise Caucasian male with the richness of her experience would more often than not reach a better conclusion than a Latina woman who hasn't lived that life."
The nation desperately needs justices who will apply the law regardless of personal preferences. Our laws require equal justice for all, not "empathy" to ethnic groups in vogue as "victims."
As Lincoln said, our nation is "dedicated to the proposition that all men are created equal."
